1. Scope
These terms of service apply to the use of the NIS2 Pilot app (hereinafter "App"), offered by:

2. Description of Services
2.1 The app provides tools for self-assessment of NIS2 directive applicability and for determining the compliance maturity level.
2.2 The app does not replace legal or professional advice. The results are non-binding and do not constitute legal advice.
2.3 The provider does not act as a lawyer and does not provide legal advice within the meaning of the German Legal Services Act (RDG).
2.4 Industry Benchmark and Comparison Values
2.4.1 The app optionally offers an industry benchmark function that compares your NIS2 maturity level with estimated averages of other companies in your sector.
2.4.2 The benchmark data is based on published industry studies (BSI, PwC, ENISA), aggregated anonymized data and estimated reference values. They are not real-time averages and not predictions for your company.
2.4.3 Your company data is not shared with other users or included in benchmark averages.
2.5 Supplier Readiness Check
2.5.1 The app optionally offers a supplier readiness check with standardized questions about NIS2 readiness in the supply chain.
2.5.2 The check does not replace formal security audits, contractual supplier assessments or legal evaluations of supplier compliance.
2.5.3 You remain solely responsible for the security of your supply chain under NIS2 Article 21(2)(d).
2.6 Cost Estimate
2.6.1 The app optionally offers a cost estimate for NIS2 implementations based on your maturity level, company size and market data.
2.6.2 These estimates are not binding offers, not financial advice, and are reference values with significant potential for deviation.
2.6.3 The provider is not liable for cost deviations or investment decisions based on these estimates.
3. No Legal Advice
3.1 All information, results and recommendations of the app — including industry comparisons, supplier readiness scores and cost estimates — serve exclusively for general orientation.
3.2 Use of the app does not establish a client relationship between the user and the provider.
3.3 For binding legal information, please consult a licensed attorney or IT security consultant.
4. Usage Rights
4.1 With the free version, you receive a simple, non-transferable right to use the basic features for private and commercial purposes.
4.2 With the purchase of premium features (Clarity / NIS2-Ready), you receive a simple, non-transferable right to use the purchased features.
4.3 Sublicensing, renting or redistribution is not permitted.
5. In-App Purchases and Right of Withdrawal
5.1 Paid features are acquired as a one-time purchase.
5.2 Processing is handled through the Apple App Store. Their terms and conditions also apply.
5.3 Exclusion of withdrawal for digital content (§ 356(5) BGB): By confirming the purchase, you agree that the delivery of digital content begins immediately. You acknowledge that you thereby lose your right of withdrawal.
5.4 Refunds are processed according to Apple's policies.
6. Limitation of Liability
6.1 The provider is not liable for damages arising from the use or non-use of the app, unless caused by intent or gross negligence.
6.2 The provider is specifically not liable for:
- Decisions made based on the app's results
- Fines or sanctions due to incorrect self-assessment
- Incorrect or incomplete information
- Damages from system failures or data loss
- Incorrect industry benchmark data or comparison values
- Cost estimates that differ from actual implementation costs
- Supplier readiness assessments that do not match formal audits
6.3 Liability for intent and gross negligence as well as for damages to life, body and health remains unaffected.
7. Warranty
7.1 The provider endeavors to provide the app free of errors, but does not warrant the accuracy, completeness and timeliness of the content.
7.2 There is no entitlement to availability or specific features.
8. Data Protection
The processing of personal data is carried out in accordance with our Privacy Policy.
9. Final Provisions
9.1 The law of the Federal Republic of Germany applies.
9.2 Should individual provisions of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
9.3 The provider reserves the right to change these terms at any time. The current version is always available at this URL.
